Terms of use

Last updated: October 14, 2026 — version 1.0

These terms of use (the “Terms”) govern access to and use of the Smartiming service: the website smartiming.net, the web application app.smartiming.net and the “Smartiming” mobile application for iPhone and Android (together, the “Service”), published by Wildpace (“we”, the “Publisher”).

By creating an account or using the Service, you accept these Terms without reservation. If you accept them on behalf of an organization (club, association, company organizing sports events), you warrant that you have the authority to bind it. If you do not accept these Terms, you must not create an account or use the Service.

The purchase of credits is governed by separate terms, the Terms of sale, which supplement these Terms without replacing them. The processing of your personal data is described in the Privacy policy.

1. Publisher of the service

Wildpace, sole proprietorship (French micro-entrepreneur) — SIRET 833338247 00020. Contact: contact@wildpace.net. Full contact details: Legal notice.

2. Definitions

  • Service: the Smartiming website, web application and mobile application, and all their features (creation of events and races, registration of participants, timing, results, public display, history, purchase of credits).
  • Organization: the entity (club, association, company, group of volunteers) on whose behalf one or more accounts use the Service.
  • Account or Member: a person who has a username and password to access the Service on behalf of an Organization, with a role (administrator, organizer, timekeeper, or bib handout).
  • Participant: a person registered for a race, whose data (name, bib, time, ranking…) are entered into the Service by the Organization. A Participant has no account: see the Privacy policy, section 1, for what to do if this concerns you.
  • Visitor: a person who views public results or uses the application's “participant” mode, without an account.
  • Credit: the Service's own unit of account, consumed in particular when a participant is registered, whose purchase is described in the Terms of sale.
  • Content: any data entered, imported or generated in the Service by an Organization or its Members (events, races, participants, results, logos, imported files).

3. Description of the service

Smartiming allows an Organization to create sports events and their races, to register participants for them, to record their split and finish times (on the fly, by voice dictation or offline), to calculate and publish rankings, to manage the bib handout, and to follow the history of its team's actions. Some features may vary depending on the platform used (website, web application, mobile application); we do not guarantee strict parity between them at all times.

A “participant” mode, without an account, allows anyone to view the results of an event whose Organization has activated their publication (Privacy policy, section 4).

4. Access to the service and account creation

  • An account is created by open sign-up or by an administrator of your organization.
  • You warrant that the information you provide (last name, first name, email address, name of the organization) is accurate and up to date, and you undertake to keep it up to date.
  • Creating an account is reserved for adults. An Organization remains responsible for the accounts created within it by its own administrators.
  • An account is personal: you are responsible for keeping your password confidential and for any action carried out from your account. Notify us without delay at contact@smartiming.net in the event of unauthorized use or loss of your password.
  • Depending on your Organization's configuration, an email address may have to be verified before the first sign-in. A forgotten password is reset through a link sent by email, valid for a limited time.

5. Roles and access rights

Within an Organization, each Member has a role that determines what they can see and modify: administrator (full management, including the other accounts), organizer (events, races, participants), timekeeper (recording splits) and bib handout (access limited to this task alone). It is up to the Organization's administrator to assign the appropriate role to each member of their team and to remove the access of anyone who leaves the team.

6. User commitments

By using the Service, you undertake to:

  • use it in accordance with its purpose: managing sports events and timing races;
  • not attempt to circumvent the security measures (limits on sign-in attempts, role checks), nor access the data of another Organization;
  • not enter data that you have no right to collect, nor use the Service for unlawful or fraudulent purposes or purposes that infringe the rights of a third party;
  • not disrupt the operation of the Service (intrusion attempts, deliberate overload, reverse engineering of the application, except within the limits permitted by law);
  • provide, for each race, a backup means of timing independent of the Service (section 10);
  • comply with these Terms, the Privacy policy and, where applicable, the Terms of sale.

Any breach may result in the suspension or termination of your access under the conditions of section 14.

7. Content entered by the organization — your responsibility

You are solely responsible for the Content you enter, import or generate in the Service: accuracy of the information, right to collect and process it, respect for the rights of the people concerned (participants, emergency contacts). In particular:

  • you warrant that you have obtained, from the participants or from their legal guardians if they are minors, the authorizations necessary to collect their data and, where applicable, to publish their results;
  • you are responsible for the validity and accuracy of the results, rankings and times you publish: see section 10;
  • you undertake to respect the right to anonymity that a participant may ask you for (“requires anonymity” checkbox, Privacy policy section 4) and not to circumvent the features provided for this purpose.

The data entered by an Organization (participants, results, logos) remain its property or that of their respective owners: we claim no rights over them, other than what is necessary to provide the Service (hosting, backup, display).

8. We act as a processor for your participants' data

For the participant data and the results you enter, you alone are the controller within the meaning of the General Data Protection Regulation (GDPR); we act as a processor, according to your instructions as documented in the Service. In accordance with article 28 of the GDPR:

  • Subject matter and duration: the processing covers the hosting, storage and display of your participants' data and the calculation of their results, for the duration of your use of the Service, plus the retention periods described in the Privacy policy (section 7).
  • Nature and purpose: timing, calculation of rankings, publication of results according to your settings, bib handout, management of the history of actions.
  • Type of data and categories of data subjects: see the Privacy policy, section 2 (“Participants”, “Emergency contacts” and “Results” rows).
  • Our obligations: we only process these data on your instructions (as expressed through your use of the Service); we ensure the confidentiality of the people authorized to access them; we implement the security measures described in the Privacy policy (section 8); we only engage a further processor (“sub-processor”) under the conditions listed in section 5 of the Privacy policy, of which you are informed by that document; we assist you, as far as possible given how the Service works, in answering a request from a participant exercising their rights, and we notify you of any data breach affecting these data as soon as possible after becoming aware of it; at the end of the contractual relationship, these data are deleted according to the periods in the Privacy policy (section 7), without automatic return — you can export your data while your account is active (export features of the Service);
  • Your obligations as controller: you warrant that the collection and processing of these data comply with the GDPR (information of the data subjects, legal basis, retention period you consider appropriate within the limits of what the Service allows); you remain solely responsible towards the participants and the supervisory authorities for complying with these obligations.

9. Credits and purchases

Some actions (in particular registering a participant) consume credits, except for organizations for which this mechanism is disabled. The purchase of credits, their prices, and the payment, invoicing and refund terms are described in the Terms of sale, which form an integral part of the contractual relationship as soon as a purchase is made.

10. Results and liability

The Service is a tool made available to Organizations: we do what is necessary for it to be available and reliable, but we do not guarantee that it is free from interruptions or errors.

The results displayed (split times, times, rankings) are based on what the Organization and its timekeepers enter in the Service: the Organization is responsible for them and validates them. They have no official value until the Organization or the competent sports federation has validated them. We are not responsible for the consequences of a data entry error, a wrongly assigned bib, a loss of connection during a race, or any decision made on the basis of results not yet validated.

Backup timing. Like any computer system, the Service may fail (outage of the server or of a provider, no network, lost, broken or discharged phone, software error). It is the Organization's responsibility to always provide an alternative means of timing each of its races, independent of the Service — for example a stopwatch and a paper record of the bibs and finish times — that allows it to establish the results if the Service is unavailable or if data are lost. We are not responsible for the impossibility of establishing or publishing the results of a race, nor for the loss of split times, due to a failure of the Service.

We are in no event responsible for the physical running of the sports events themselves (safety on the course, supervision, participants' insurance): these obligations lie exclusively with the Organization.

11. Availability, maintenance and changes to the service

We may temporarily suspend the Service for maintenance, including without notice in an emergency (security flaw). Where possible, we inform Organizations of scheduled maintenance likely to affect a race in progress.

We evolve the Service (new features, fixes, interface changes). A minimum version of the mobile application may be required: below it, the application displays a message asking you to update it before you can continue to use it.

12. Intellectual property

The name Smartiming, the logo, the graphics, the texts and the code of the Service are the property of Wildpace and are protected by intellectual property law. We grant you a personal, non-exclusive and non-transferable right to use the Service, for the duration of your account and within the limits of these Terms. Any unauthorized reproduction or reuse of the Service itself (beyond the use provided for by these Terms) is prohibited.

13. Public links and publication of results

You can activate public links allowing third parties to view the results of your events without an account (results, display screen, “latest splits”). You remain solely responsible for the choice to activate or deactivate these links and for the consequences of sharing them. Details of what these links show, of the possible anonymization of a participant and of indexing by search engines are given in the Privacy policy, section 4.

14. Suspension and termination by us

We may suspend or terminate your access to the Service, in whole or in part:

  • without notice, in the event of a serious breach of these Terms (fraud, attack on the security of the Service or on the data of another Organization, unlawful use);
  • with 15 days' notice in other cases of breach, after giving you formal notice to remedy it;
  • in the event of non-payment of a credit purchase (see the Terms of sale).

Suspension or termination does not result in the immediate deletion of your data: they follow the retention periods described in the Privacy policy (section 7).

15. Termination by you

You can stop using the Service at any time. You can delete your own account, or, if you are an administrator, the whole Organization, from the application (profile menu → “My account”). The consequences (period before permanent erasure, possible restoration, case of the last administrator) are described in the Privacy policy, sections 7 and 10.

16. Complaints and reported content

If a results page or a public entry concerns you (you are a participant) and you would like it corrected, hidden or deleted, contact the Organization concerned first, or write to us — see the Contact page and the Privacy policy, section 1.

17. Changes to these Terms

We may change these Terms, in particular to reflect a change in the Service or in the regulations. The date of the last update appears at the top of this page. In the event of a significant change, we will inform you in the application. Continuing to use the Service after a new version comes into force constitutes acceptance of it.

18. Severability

If any clause of these Terms is held to be invalid or unenforceable, the other clauses remain fully applicable.

19. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the French courts have jurisdiction.
